Introduction
Welcome to XRAY Commerce. These Terms and Conditions (“Terms”) govern your use of our Chrome Extension, web application, APIs, and other related services (collectively, the “Service”). By accessing or using XRAY, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not use the Service.
You must be at least 13 years old to use the Service. By using XRAY, you represent and warrant that you meet this requirement.
To access certain features, you may be required to register for an account. You agree to provide accurate, complete, and current information during registration and to keep this information up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
a. Compliance: You agree to use the Service in compliance with all applicable laws and regulations.
b. Prohibited Conduct: You shall not use the Service for any illegal, unauthorized, or harmful activity. This includes, but is not limited to:- Uploading content that is unlawful, defamatory, or infringing- Gaining unauthorized access to XRAY systems or data- Disrupting or interfering with XRAY services or infrastructure
c. Intellectual Property: All text, graphics, software, and content are the property of XRAY or its licensors and are protected by intellectual property laws. You may not copy, distribute, or modify any content without written permission.
Some features of XRAY may require a paid subscription. By purchasing a subscription, you agree to pay the applicable fees. All payments must follow XRAY’s billing terms. XRAY reserves the right to change pricing with notice to users. Fees are non-refundable unless otherwise stated.
XRAY operates a credit-based model for accessing core functionality:
- Credits may be purchased or earned (e.g., referrals or promotions)
- Subscription plans may include recurring credits
- Credits are used for listing optimization, tag generation, image enhancement, and other AI featuresUnused credits have no cash value and may not be transferred. XRAY may modify how credits are awarded, consumed, or reset.
XRAY offers image enhancement features to help improve listing performance. However, the user is solely responsible for selecting and publishing final image outputs. XRAY assumes no liability for customer or platform outcomes related to image usage.
Use of XRAY is subject to our Privacy Policy. By using the Service, you consent to the collection and processing of your data as described in that policy.
XRAY reserves the right to suspend or terminate your access to the Service at any time for violation of these Terms or any behavior deemed harmful to the platform or other users. Upon termination, your right to access the Service ends immediately.
The Service is provided "as is" and "as available" without warranty of any kind. XRAY does not guarantee uninterrupted or error-free operation. Use of the Service is at your own risk.
To the fullest extent permitted by law, XRAY and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising out of or in connection with your use of the Service.
These Terms shall be governed by the laws of the State of Texas. Any disputes arising from these Terms shall be resolved exclusively in the courts of Dallas County, Texas.
XRAY Commerce currently supports users located in the United States only. Access to the Service, including billing and feature availability, is intended solely for U.S.-based users. XRAY reserves the right to expand or modify this availability in the future.
The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. XRAY does not guarantee that the service will be uninterrupted, secure, or error-free. Your use of the Service is at your own risk.
XRAY reserves the right to modify or update these Terms at any time. Any changes will be effective upon posting the revised Terms on the XRAY website or other appropriate communication channels. Your continued use of the service after any such changes constitutes your acceptance of the modified terms.
